south dakota just passed legislation that bans abortion. doctors who perform the procedure will face a felony and 5 years in jail. this legislation goes into effect in july but court cases will hopefully prevent it's implementation.
i decided to take a look at the actual legislation titled "Women's Health and Human Life Protection Act" HB1215. it's always interesting to see what people come up with. abortion is now illegal in south dakota in order to "fully protect the rights, interests, and health of the pregnant mother, the rights, interest, and life of her unborn child, and the mother's fundamental natural intrinsic right to a relationship with her child. "
hmmmmmmmm let's take a closer look at the part i italicised. I am not a mother so maybe i can not comment on this but it seems to me that they made up that natural intrinsic right to further their own restrictive aims. do more people recognize this right? is it in the universal declaration of human rights? let me check.
nope. there are 30 articles and none of them mention any such right. the closest they come is saying in article 16 section c) The family is the natural and fundamental group unit of society and is entitled to protection by society and the State.
not only is this troubling but i think that this "right" and this law have been made not by women for women, but by politicians, many whom are not women and will never be pregnant and/or have an abortion. their desire to control our bodies and restict our ability to take charge of our lives and our familes can only have detrimental affects on women's health.
on a side note, i just finished reading the book " Love the Sin: Sexual Regulation and the Limits of Religious Tolerance" by Janet R. Jakobsen and Ann Pellegrini. These women present a great argument for the disestablishment of religion and sexuality as the way to get to religious and sexual freedom in this country. they argue that we can't be free sexual beings if we can't be free to practice our religions. check it out
